iVybe Terms of Service

1. Agreement

These Terms of Service ("Terms") are a legal agreement between you and Fadi A Adib ("iVybe," "we," "us") governing your use of the iVybe mobile app and website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

Please also read our Privacy Policy, which explains how we handle your information and is part of your agreement with us.

2. Who can use iVybe

• You must be at least 18 years old. iVybe is an adults-only service. By using it, you represent that you are 18 or older.
• You must be legally able to enter into these Terms.
• You must not have been previously banned from the Service.
• You may not use the Service where it would be illegal to do so.

3. Your account

• Sign-in. You access iVybe by signing in with Apple or Google. You are responsible for keeping access to that account secure.
• Accurate information. You agree that the information you provide — your name, age, photos, and profile details — is truthful and is your own. Impersonation and fake profiles are not allowed.
• One person, real presence. iVybe is built on genuine physical presence. You agree not to falsify your location or otherwise misrepresent where you are.

4. What iVybe is

iVybe helps people who are physically near each other discover a shared moment and connect. Connections and chats on iVybe are ephemeral by design — they are tied to presence and are meant to fade when the moment does. You understand and accept that:

• Chats and connections are not permanent and will end and be deleted, consistent with our Privacy Policy.
• The Service depends on your device's location and on third-party services (such as Apple, Google, and venue data), which we don't control and can't guarantee.

5. Community rules

To keep iVybe safe and welcoming, you agree not to:

• Harass, threaten, abuse, stalk, or intimidate anyone.
• Post or send content that is unlawful, hateful, sexually exploitative, or that sexualizes or endangers minors.
• Share another person's private information, or record or share others without consent.
• Impersonate anyone, create fake profiles, or misrepresent your identity, age, or location.
• Use the Service for solicitation, spam, scams, commercial promotion, or to distribute contact details to circumvent our systems.
• Attempt to identify, track, or contact another user outside the Service against their wishes.
• Interfere with, probe, or attempt to break the Service's security or systems, or use bots or automated access.

Violating these rules can result in content removal, suspension, or permanent removal from the Service.

6. Safety, blocking, and reporting

• You can block and report other users at any time from within the app.
• We operate safety systems that act on reports and detect abuse. Serious violations may lead to immediate suspension pending review, and permanent removal if confirmed.
• We are not obligated to monitor all content, but we may review, remove, or act on content and accounts that violate these Terms.
• Meeting people carries real-world risk. iVybe facilitates introductions but does not conduct background checks and does not vet users. You are responsible for your own safety when interacting with or meeting anyone. Use good judgment: meet in public, tell someone where you're going.

7. Your content

• You own your content. You keep the rights to the photos, profile text, and messages you create.
• You grant us a limited license to host, store, display, and transmit your content as needed to operate the Service (for example, showing your photo to a nearby user). This license ends when your content is deleted, subject to the retention described in the Privacy Policy and to any content we must retain for safety or legal reasons.
• You're responsible for your content and represent that you have the right to share it and that it doesn't violate these Terms or anyone else's rights.

8. Our content and intellectual property

The Service itself — the iVybe name, brand, design, software, and content we create — belongs to us or our licensors and is protected by intellectual-property laws. You may not copy, modify, reverse-engineer, or create derivative works from the Service except as allowed by law.

9. Notifications and location permissions

The Service asks for location and (optionally) notification permissions. You control these through your device and the app's settings. Denying location will prevent the core discovery experience from working. You can withdraw permissions at any time.

10. Deleting your account and termination

• You can delete your account at any time from within the app, which erases your data as described in the Privacy Policy.
• We may suspend or terminate your access if you violate these Terms, if required by law, or to protect users or the Service. Where appropriate and lawful, we'll aim to give notice — but serious safety violations may result in immediate action.
• Certain provisions survive termination (for example, safety-record retention, intellectual property, disclaimers, and limitation of liability).

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your expectations, that any connection or match will occur, or that other users are who they claim to be. Your use of the Service and any interaction with other users is at your own risk.

12. Limitation of liability

To the fullest extent permitted by law, Fadi A Adib and the operators of the Service will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of — or inability to use — the Service, your interactions with other users, or any offline meeting or conduct. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.

13. Disputes and governing law

These Terms are governed by the laws of Oregon, United States, without regard to conflict-of-laws principles.

14. Changes to these Terms

We may update these Terms from time to time. When changes are material, we'll update the "Last updated" date and, where appropriate, notify you in the app. Continuing to use the Service after a change means you accept the updated Terms.
